These terms govern your use of Scriptwell, a prescription dispensing and delivery service operated by TerryWhite Chemmart Armstrong Creek (“we”, “us”). By placing an order through Scriptwell you agree to these terms. Please read them alongside our Privacy Policy and our Delivery, Returns & Refunds policy, which form part of these terms.

1. What Scriptwell is

Scriptwell lets you send a valid prescription you already hold to our pharmacy, where it is dispensed by a registered Australian pharmacist and delivered to you or collected in person. Scriptwell is not a prescribing service and is not a substitute for medical advice. We do not issue prescriptions and we do not help you obtain one — you must already have a lawful, valid prescription from your own treating practitioner.

3. Prescriptions and pharmacist discretion

You confirm that any prescription you submit is genuine, was issued to you, and has not been altered. We verify that a lawful supply pathway exists before dispensing. A pharmacist may, in their professional judgement and consistent with their legal and ethical obligations, decline to dispense, request further information, or contact your prescriber — for example where there is a safety concern or a question about the prescription. If we cannot lawfully or safely supply, we will not charge you, or we will refund you in full.

5. Orders, stock and substitution

Every order is subject to stock and to pharmacist confirmation. If an item is unavailable, or a substitution may be appropriate, we will contact you and will only substitute with your agreement. An order is accepted once the pharmacist has confirmed it and payment has been completed.

Delivery timeframes, pickup, and carrier details are set out in our Delivery, Returns & Refunds policy. Please make sure your delivery address is correct — we are not responsible for delays or non-delivery caused by an incorrect address.

7. Cancellations, returns and refunds

Your rights to cancel an order, and the rules for returns and refunds of dispensed medicines, are set out in full in our Delivery, Returns & Refunds policy. In short: you may cancel before your order is dispensed and dispatched, but dispensed prescription medicines cannot be returned once they have left the pharmacy. Your consumer guarantees under the Australian Consumer Law are not affected.

8. Your account and security

Access to your orders is protected by a secure link and your date of birth. Keep these private. Tell us promptly if you think someone else has accessed your account. We may suspend access where we reasonably suspect misuse.

9. Acceptable use

Medicines dispensed to you are for your personal use only. You must not resell, re-supply or share prescription medicines with anyone else.

10. Privacy

We handle your personal and health information in accordance with our Privacy Policy.

11. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, our liability for any claim relating to your use of Scriptwell is limited to re-supplying the relevant goods or services or paying the cost of doing so. We are not liable for loss caused by circumstances outside our reasonable control.

12. Changes to these terms

We may update these terms from time to time. The “Last updated” date above reflects the most recent revision, and the terms in force when you place an order apply to that order.

13. Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
